Question:

Must a qualified firm as defined in K.S.A. 74-50,131, maintain certification through the HPIP program in
order to claim any excess carry forward credit in succeeding tax years?

Answer:

To claim any remaining HPIP credit, a qualified firm must be recertified by the Department of Commerce
and Housing for the majority of that tax year (185 days) in which the carryforward is to be claimed, except
that no carry forward shall be allowed for deduction after the 10th taxable year succeeding the taxable year
in which the credit initially was claimed.
